According to Supreme Court Judgment on Sexual Harassment, on the case of Vishakha Vs. the State of Rajasthan (August 1977), the behavior that can be considered as sexual harassment has been explicitly, legally defined as following-Sexual Harassment includes :
The critical factor in sexual harassment is the un-welcomeness of the behavior. For any such unfortunate alleged occurrence, the employee has to obligatorily file a complaint to the Gender Complaints Committee. It shall be the duty of the Gender Complaints Committee to make preliminary investigations into a complaint made to it by a complainant, hold enquiries into such complaints, to resolve the matter by delving deep into its merits/demerits, and to issue orders pursuant to the findings of the enquiry.
